Welcome to PickGenius. These Terms of Service ("Terms") govern your access to and use of the PickGenius website, application, and services (collectively, the "Service"). Please read these Terms carefully before using our Service.

By accessing or using PickGenius, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Description of Service

            Important: PickGenius is an information and analysis service only. We provide statistical analysis, predictions, and data-driven insights related to football matches. We do NOT accept bets, hold customer funds for wagering, or operate as a bookmaker or betting exchange.
        

The Service provides:

Statistical analysis of football fixtures using our proprietary WinIndex algorithm
AI-enhanced predictions and confidence scores
Historical data and match information
Curated weekly and daily picks based on algorithmic analysis

2. Age Requirement

You must be at least 18 years old to use this Service. By using PickGenius, you confirm that you are at least 18 years of age. We reserve the right to verify your age and terminate accounts of users who are under 18.

3. Account Registration

To access certain features of the Service, you must register for an account. When you register, you agree to:

Provide accurate, current, and complete information
Maintain and update your information to keep it accurate
Keep your password secure and confidential
Accept responsibility for all activities under your account
Notify us immediately of any unauthorized use of your account

4. Subscription Plans and Payments

4.1 Free Trial

We offer a 7-day free trial for new users. No payment information is required to start the free trial. At the end of the trial, you may choose to subscribe to a paid plan or your access will be limited.

4.2 Paid Subscriptions

We offer the following subscription plans:

Basic (£9.99/month): Weekly top picks, WinIndex scores, and AI analysis
Premium (£19.99/month): All Basic features plus daily picks, full database search, and historical data

4.3 Billing

Subscriptions are billed monthly in advance. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel. Prices are in GBP and include VAT where applicable.

4.4 Cancellation

You may cancel your subscription at any time through your account settings. Upon cancellation:

You will retain access until the end of your current billing period
No refunds will be provided for partial months
You may resubscribe at any time

4.5 Consumer Rights

Under the Consumer Contracts Regulations 2013, you have a 14-day cooling-off period from the date of purchase. However, by accessing the Service immediately upon subscription, you acknowledge that you may lose this right if you begin using the Service within the 14-day period.

5. Intellectual Property Rights

⚠️ Proprietary Algorithm Protection: The WinIndex algorithm, scoring methodology, data analysis techniques, and all related intellectual property are trade secrets of PickGenius. Any attempt to reverse engineer, copy, replicate, or derive our algorithms is strictly prohibited and may result in legal action.

5.1 Our Intellectual Property

All content, features, and functionality of the Service, including but not limited to:

The WinIndex algorithm and all derivative calculations
AI analysis methodologies and prompts
Data processing and aggregation techniques
User interface designs and layouts
Logos, trademarks, and brand elements
Written content, graphics, and code

are owned by PickGenius and protected by copyright, trademark, trade secret, and other intellectual property laws.

5.2 Prohibited Activities

You agree NOT to:

Copy, reproduce, or redistribute our content or picks without authorization
Attempt to reverse engineer, decompile, or derive the WinIndex algorithm
Use automated tools (scrapers, bots) to extract data from the Service
Resell, redistribute, or commercially exploit our analysis or picks
Create derivative works based on our methodology
Share your account credentials or allow others to access your subscription
Remove or alter any proprietary notices or labels

5.3 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use only, subject to these Terms.

6. Disclaimers and Limitations

⚠️ No Guarantee of Results: Football outcomes are inherently unpredictable. Our analysis is based on historical data and statistical models, but past performance does not guarantee future results. We make no guarantees about the accuracy of our predictions or your betting outcomes.

6.1 Information Only

The Service provides information and analysis for entertainment and informational purposes only. Our picks and predictions are NOT:

Financial advice or investment recommendations
Guaranteed winning strategies
Encouragement to gamble

6.2 Your Responsibility

You are solely responsible for:

Any betting decisions you make
Complying with gambling laws in your jurisdiction
Managing your gambling activity responsibly
Any losses incurred from betting

6.3 Limitation of Liability

To the maximum extent permitted by law, PickGenius and its owners, employees, and affiliates shall not be liable for:

Any indirect, incidental, special, consequential, or punitive damages
Any loss of profits, revenue, data, or betting losses
Any damages arising from your use or inability to use the Service

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

6.4 Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7. Responsible Gambling

We strongly encourage responsible gambling. If you choose to bet based on our analysis:

Only bet what you can afford to lose
Set limits on your time and money spent gambling
Never chase losses
Take breaks and maintain balance in your life

8. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, if:

You breach any provision of these Terms
We suspect fraudulent, abusive, or illegal activity
We are required to do so by law
We discontinue the Service

Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, and limitations of liability.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PickGenius regarding the Service and supersede all prior agreements and understandings.
